Texas Hemp Update 2026: Our New Compliant Flower & Delta-9 Pre-Rolls

Texas hemp rules have changed quickly, and headlines about a “THCA ban” can make the situation sound simpler than it is. The broad hemp ban passed by the Texas Legislature as Senate Bill 3 in 2025 did not become law because Governor Greg Abbott vetoed it. Since then, however, Texas regulators and the Texas Supreme Court have made major changes affecting THCA, delta-8 THC, and other consumable hemp products.

Here is a plain-language look at the rules in effect as of September 4, 2026—and how Puff n' Stuff has adjusted its McAllen selection to focus on products represented and documented as Texas compliant.

Did Texas Ban THCA Flower?

Texas did not enact the sweeping ban proposed in 2025. The state's current testing rule does, however, make an important change: it counts THCA when calculating a product's total delta-9 THC. The calculation looks at the delta-9 THC already present plus the delta-9 THC that THCA could produce after heating, a process called decarboxylation.

Under the rules that took effect March 31, 2026, a consumable hemp product must test at no more than 0.3% total delta-9 THC on a dry-weight basis, taking the laboratory's measurement of uncertainty into account. Because high-THCA flower can convert to a much higher level of delta-9 THC when heated, many products previously sold as THCA hemp flower may not meet this updated total-delta-9 standard. What Happened to Delta-8 and Other THC Derivatives?

On May 1, 2026, the Supreme Court of Texas ruled that the Department of State Health Services had authority to place manufactured delta-8 THC on the state's controlled-substance schedule. Texas then reinstated the relevant schedule language effective July 31, 2026.

DSHS now says that only naturally occurring trace amounts of delta-8 THC in the hemp plant are permissible. According to the agency, consumable hemp products labeled as containing delta-8—or shown by testing to contain more than trace amounts of tetrahydrocannabinols, including delta-8—may be detained and referred to law enforcement. A product name alone—whether it says delta-8, delta-9, THCA, or another THC derivative—does not prove that the product is lawful in Texas. The cannabinoid source, laboratory results, total-delta-9 concentration, packaging, labeling, and current controlled-substance schedule all matter.

Texas's Current Rules at a Glance

• Total delta-9 testing: THCA is included when determining potential total delta-9 THC.
• 0.3% limit: Consumable hemp products must remain at or below 0.3% total delta-9 THC on a dry-weight basis under the current Texas testing rule.
• Delta-8: DSHS says only naturally occurring trace amounts are permissible under the schedule effective July 31, 2026.
• Age requirement: Buyers must be at least 21, and sellers must check valid government-issued identification before completing a sale.
• Laboratory documentation: Products must be supported by required testing and a current certificate of analysis, commonly called a COA.
• Packaging and labels: Products must meet Texas requirements for warnings, batch information, COA access, tamper evidence, and child-resistant packaging.

A Note About Smokable Hemp Products

Texas distinguishes between manufacturing and retail sales. DSHS states that manufacturing or processing consumable hemp products for smoking in Texas—including certain private-labeling activities—is prohibited. The agency also states that properly registered retailers may sell properly packaged, labeled, and tested smokable hemp products manufactured outside Texas. How to Shop Responsibly

• Bring a valid, unexpired government-issued photo ID. Consumable hemp products are for customers age 21 and older.
• Read the entire package and follow the labeled serving directions.
• Use the package's URL or QR code to review the COA and confirm it matches the product and batch.
• Keep all hemp products secured, in their original child-resistant packaging, and away from children and pets.
• Do not drive, operate machinery, or combine intoxicating products with alcohol or other impairing substances.
• Remember that THC products may cause impairment and may result in a positive drug test.
